Subject: BS: DoMA struck down by judge. From: Jack the Sailor Date: 19 Oct 12 - 10:31 AM A small victory for equality. |

Subject: RE: BS: DoMA struck down by judge. From: Richard Bridge Date: 19 Oct 12 - 11:37 AM The next step presumably is to require all states (and all sources of, say, benefits and pensions etc) to recognise marriages formed in any other states. |

Subject: RE: BS: DoMA struck down by judge. From: Jack the Sailor Date: 19 Oct 12 - 11:40 AM That is not possible from the federal level. The next step, will be, hopefully, more federal recognition of same sex equal rights. |

Subject: RE: BS: DoMA struck down by judge. From: Bill D Date: 19 Oct 12 - 11:53 AM Presumably so... but with this system of "States Rights" that we labor under, conservatives seem to think that it is ok to use imaginary lines marking old boundaries to exclude 'fairness'. That is what out Civil War was about, and why we still have educational and civil practices that make some things... like alcohol,or gun laws, or abortion, or marriage...etc... legal on one side of a street or river, and illegal on the other. 250 years ago, there were some reasons for this 'independence' ... now these most of these rules are anachronisms, but the system for CHANGING the rules often depends on Constitutional amendments... which must be approved by the very states which don't want the changes. Fun, hmmm? |

Subject: RE: BS: DoMA struck down by judge. From: Jack the Sailor Date: 19 Oct 12 - 12:02 PM Obviously if the SCotUS finds a state law unconstitutional then similar laws in other states are under threat. But DoMA is a Federal law and in this court case the issue is federal taxes. |

Subject: RE: BS: DoMA struck down by judge. From: Bill D Date: 19 Oct 12 - 02:32 PM We still face the prospect of SCotUS finding that the individual states may do as they wish... and know that there will be MUCH pressure from a number of states to do just that. |

Subject: RE: BS: DoMA struck down by judge. From: Richard Bridge Date: 19 Oct 12 - 02:56 PM I would have thought that the US government could require recognition by all states of marriages in all states. The US generally recognises foreign marriages: http://travel.state.gov/law/family_issues/marriage/marriage_589.html But international harmonisation of marriage law is far from complete - and this wikipedia article presages the potential problems surrounding same sex marriage http://en.wikipedia.org/wiki/International_matrimonial_law |

Subject: RE: BS: DoMA struck down by judge. From: Jack the Sailor Date: 19 Oct 12 - 03:00 PM The US generally recognises foreign marriages: The case in question was about a Canadian marriage. |

Subject: RE: BS: DoMA struck down by judge. From: gnu Date: 19 Oct 12 - 03:58 PM Marriage or civil union? The goverments have nothing to do with marriage. Marriage is bettween a human(s) and a church. |

Subject: RE: BS: DoMA struck down by judge. From: Jack the Sailor Date: 19 Oct 12 - 04:15 PM Lots of people get married by Judges and JP's even sea Captains. |
|
Subject: RE: BS: Defense of Marriage Act struck down by judge. From: Stilly River Sage Date: 19 Oct 12 - 06:00 PM Marriage isn't between humans and a church. Churches are allowed to perform marriages but people still need to have the governmental marriage licence for it to be legal beyond the church. We were married by a county court at law judge. SRS |
